The Crown Appeals The Frank Smith Case

The Prosecution in the case of former Senator Senator Frank Smith vs Barbara Hanna has filed for special leave to appeal the verdict at the Privy Council level. The Government notified Damien Gomez Q C for Mr. Smith on Thursday 17 October 2019.  Chairman of the PLP Senator Fred Mitchell derided the decision as another example of victor’s justice and persecution of PLPs and a complete waste of money.  Mr. Smith was acquitted at the Magistrate’s Court level and at the Court of Appeal level.  The Crown has no right of appeal so they have to convince the Privy Council that there is some special reason to do so. Politics under the FNM has become ridiculous.
